Terms
Terms of sale are cash, check, sight draft or other terms agreed
to in writing between seller and buyer, payable immediately upon
conclusion of the sale and before animals will be released. Sell-
ers will reserve the right to require a certified check as settlement
before releasing any cattle.
Post Sale Protocol
All fall, 2 year old bulls and bred heifers must be loaded out
sale day. In the case of an on order or internet purchases, ar-
rangements will be made until trucking arrangements can be
made.
Insurance on Purchases and Risk
All animals are at owner’s risk prior to their sale and become
the property of the purchaser as soon as declared sold by the
auctioneer. Insurance will be available sale day.
Bidding
All animals sell to the highest bidder. Any disputes or challenges
regarding bids will be settled by the auctioneer and his decision
is final.
Liabilities
All persons who attend the sale do so at their own risk and NCC
assumes no liabilities for accidents that may occur. NCC assumes
no liability for loss or injury to livestock due to theft, mysterious
disappearance, sickness, improper handling or act of God.
Announcements
Announcements from the auction block will take precedence
over the printed matter in this catalog and other announcements.
Contract
The above terms and guarantees shall constitute a contract
between the buyer and seller of each animal sold.
Trucking
Assistance will be given in making trucking arrangements after
the sale, but no risk will be assumed by the seller. Expenses inci-
dent there-to are the responsibility of the purchaser, who should
furnish instructions at the time of settlement. It is recommended
insurance be obtained.
Health
All animals will be accompanied by proper health certificates
making them eligible for interstate shipment.
Breeding Statement
It will be the responsibility of the buyer to have the bulls semen
tested before they are turned out with cows or before 15 months
of age, whichever comes first. If not done, Nagel Cattle Co., is
not responsible. Any bull that has not proven itself a breeder, in
the healthy condition, may be returned to seller at the buyer’s
expense. Seller reserves the privilege of trying to prove the bull
a breeder, the seller, at his option may either return purchase
price to the buyer or replace the animal with another of equal
value in full settlement and satisfaction of all claims. In no event
shall the seller be responsible for more than purchase price. If a
bull becomes a non-breeder by reason of injury, negligence or
mismanagement, a breeding gurantee is not given. This breeding
guarantee is given regarding artificial collection, preparation or
storage of semen. In cases where the animal is subjected to any
hormonal or surgical reproduction techniques after the sale, the
seller is not responsible. This ceases when a bull is disposed of by
the buyer.
Yearling Bull Wintering Options
We would be glad to winter your yearling bull(s) until April
1, 2013. You can pick up your purchase anytime that fits your
schedule, however ALL bulls need to be picked up by April 1.
We will take care of the bulls to the best of our ability. There
will be no guarantee against injury and death.
Those that take their yearling bulls sale day will receive a $50
credit off their purchase price.
