BIDDING:
Each animal on which there are two or more bids will be sold to the highest bidder. Consignors may bid on and/or purchase any
animal in the sale.
TERMS:
Terms of the sale are cash or valid check. Make checks payable to American Beefalo Association. Settlement must be made im-
mediately after completion of the sale and prior to removing animals from the facility.
DISPUTES:
The auctioneer will settle any dispute as to bids declaring all bids void and re-selling the animal in question.
HANDLING:
All animals will be maintained prior to the sale at the absolute risk of the seller. All animals are to be maintained at the purchas-
er’s risk as soon as they are sold.
BREEDING GUARANTEE:
All animals sold are guaranteed to be breeders by the seller. Females safe in calf or with calves at side are
considered breeders. Females which have been bred less than sixty days will be sold as serviced and not guaranteed safe in calf. Females
sold as open are so guaranteed. If a female sold as safe in calf proves to be open at the time of sale, seller shall have the option of return of
the heifer to get safe in calf or replace with bred female of equal value or refund of full purchase price either of which will be considered full
settlement.
Any animal that has not proven itself a breeder within six (6) months after date of sale, if in healthy condition, may be returned to the seller
at the seller’s expense. Should the animal fail to prove a breeder with six (6) months trial by the seller, the seller, at his option may either
return the purchase price to buyer or replace the animal with another of equal value in full settlement and satisfaction of all claims. If proven
to be a breeder, buyer will pay for return to his farm.
All complaints regarding breeding difficulties must be reported in writing by the buyer to the seller within the limit specified above and ani-
mals returned must be disease free and in good condition.
REGISTRATION:
Registration certificates on Beefalo animals will be transferred to the purchaser by the seller. Breeding dates and sires on
bred females will be furnished by the seller to the purchaser for recording. A.I. certificates must be furnished with any animal that was artifi-
cially inseminated in order to register the animal.
HEALTH:
The owner of each animal sold will have such animal tested for Tuberculosis and Brucellosis no sooner than thirty (30) days prior
to sale date, and only animals free from such diseases will be permitted to be sold. All females will have been calfhood vaccinated for Bru-
cellosis. Proper certification will be furnished the purchaser by the seller guaranteeing the animal sold to be free from the above diseases.
Animals officially calfhood vaccinated for Brucellosis and not over eighteen (18) months old are exempt from test.
NOTICE:
It is the sole responsibility of the consignor or seller to make positive identification of his animal at point of sale and to match the
identification information furnished to the sale in preparation of the sale catalog.
In the event of default in any part of the Terms and Conditions covering this sale by either the buyer or the seller, it shall be the responsibility
of the buyer or seller to instigate any action necessary to bring about a fair settlement of any claims arising from this sale and to be respon-
sible for any or all costs involved therein.
ANNOUNCEMENTS:
Announcements from the auction box will take precedence over the printed matter in this catalog and all other an-
nouncements.
LIABILITIES:
All persons who attend the show and/or sale do so at their own risk and neither the owner nor the sale manager assumes
liability, legal or otherwise for any accidents that may occur.
CONTRACTS
: The above Terms and Conditions shall constitute a contract between the buyer and seller of each animal sold.
