TERMS & CONDITIONS
TERMS - The terms of the sale are cash or check payable
immediately following the sale unless proper credit arrangements
have been made prior to the sale. The right of property shall not pass
until settlement is made. All settlements must be made with the clerks
of the sale before any cattle will be released.
PURCHASER’S RISK - Each animal becomes the risk of the
purchaser as soon as sold. Loading assistance will be provided after
settlement.
INSURANCE - Insurance coverage on all animals can be secured at
time of settlement. Insurance will be available for all your insurance
needs.
ANNOUNCEMENTS - Announcements made from auction block
by owners or auctioneer takes precedence over any and all printed
matter in this catalog.
CERTIFICATE OF REGISTRY - Each Salers animal selling will
carry papers issued by the American Salers Association. A certificate
of registry will be transferred to the buyer of each animal after
settlement has been made. (The vast majority of sellers do not
transfer certificates of registries on percentage bulls, another plus you
receive at GG&T)
BREEDERS GUARANTEE, FEMALES - Cows represented as
being “safe in calf” are considered breeders without further
guarantee. All open females sell as guaranteed breeders. In an event
a female is claimed to be a non-breeder, after having been bred
regularly to a bull known to be a breeder, the matter must be reported
in writing to the seller within nine months from date of sale to the
seller in writing. Heifers under twelve months that sell who fail to
conceive to a bull known to be a breeder must be reported in writing
before the heifer reaches eighteen months of age. The seller shall
have six months to prove said animal. Any female that is subjected to
hormonal or surgical reproduction techniques shall cause this
guarantee to be null and void. At no time shall seller be liable for
more than purchase price. No guarantee is given that heifers will
deliver live calf.
BREEDERS GUARANTEE, BULLS - Should any bull fourteen
months of age or more be claimed to be a non-breeder after being
used on cows known to be breeders, the matter shall be reported in
writing to the seller within six months following date of purchase
or six months after bull has reached fourteen months of age. The
seller shall then have six months to prove said animal a breeder.
No guarantee is given that semen collected from a bull will freeze.
At no time shall seller be liable for more than purchase price or any
incidental or consequential damages.
SETTLEMENT - In the event the animal is proved a non-breeder,
a satisfactory settlement will be made with a replacement of equal
value, credit extended towards the purchase of another animal,
or money refunded if no replacements are available. Animals
returned must be in good breeding condition and in excellent
health, and must be accompanied by official health certificates.
ACCIDENTS - Although every precaution will be taken to protect
the safety and comfort of our customers, GG&T Land & Cattle
Co., consignors and auctioneers assume no responsibility in this
matter and disclaims any liability, legal or otherwise, in the event
of accident or loss of personal property.
RIGHTS AND OBLIGATIONS - The above terms and conditions
of the sale shall constitute a contract between the buyer and seller
only and be equally binding on both. Resale of animals following
purchase in this sale shall constitute a separate transaction and the
rights and obligations of the two parties connected thereto are not
covered by the terms and conditions of this sale.
INTERSTATE HEALTH CERTIFICATES will be provided. All
Bulls are PI-BVD tested Negative.
