Terms and Conditions
1.
The highest bidder is to be the buyer. If any dispute arises between or among any two or more bidders, sole authority to settle the dispute as he/she sees it is
reserved by the auctioneer and his decision shall be final. The auctioneer reserves the right to reject any and all bids. The auctioneer will decline any bid made
by parties who have defaulted in former purchases.
2.
The Sale Management is not responsible for the integrity of any specific bid and the seller understands and assumes all responsibilities for any bid that is made
and not thereafter honored. In the event any bid is not honored, the seller agrees not to hold the Sales Management responsible and agrees not to sue the Sales
Management hereof.
3.
Terms of the sale are CASH and payment in full of purchase price, plus transfer fee and must be made to the cashier during or immediately after the sale.
Payment shall be in form of cash, cashier’s check, personal check or traveler’s check. Driver’s license or some other form of positive identification is required
for personal checks.
4.
Horses are the buyers’ expense and risk the responsibility from the time of purchase, but no delivery will be made until final settlement has been made.
5.
All horses are offered for sale according to the laws of the State of Texas, and the right to bid is reserved for all sellers in the sale unless otherwise announced.
6.
All horses are sold “as is”. There is no guarantee of any kind as to the soundness, condition or other quality of any horse sold in this sale. Right of recourse must
be directly to the owner.
7.
All registration papers will be withheld by Sale Management until all checks clear the bank. At such time, they, along with transfer certificates, will be mailed to
the American Quarter Horse Association for processing of transfer.
8.
Auctioneers and personnel, do not act as agents for or represent the buyer or seller, but merely provide a medium for bringing together the buyer and seller for
the purpose of sales transaction. The Sales Management assumes no liability for either buyer or seller.
9.
Any person signing a check in the State of Texas is liable for the amount of the check. Any person giving an “insufficient funds” check or running an order to
“stop payment” of check will be prosecuted to the full extent of the law.
